WASHINGTON -- Pfizer Inc. said Monday it will not pay a $3 billionfine for an alleged illegal marketing of the drug Viagra, which it alleges was improperly promoted in the U. S. by some members of its family.
The company will pay $3 billion to resolve the allegations, and will begin testing its drugs in the U. in the fall of 2015.
It did not immediately return a request for comment.
Pfizer said it will begin conducting tests and trials of its drugs on the Web.
Pfizer will continue to market the drug in the U. S., although its FDA-approved name-brand product, the generic version, is not currently available in the U.
Pfizer said it will begin testing the drug in other countries, and it will also begin testing the drug in the U. in the next two years.
Pfizer said it did not have "an agreement" with the FDA and that the company had "no reason to believe" that it was doing what it was directed to do.
Pfizer is seeking U. regulatory approval to market its drugs for sexual health and was not required to disclose its drug use.
In May 2014, Pfizer acquired the rights to the drug from a rival drugmaker, CVS Corp., which was to sell the drug for $9 billion.
CVS sold the rights to the drug in the U. in the spring of 2013.
Pfizer said in a statement it will not treat any of the allegations against the company and will continue to market its drug.
The pharmaceutical giant said the FDA had determined the risks of the drugs outweigh the benefits to patients.
"The FDA has determined that these drugs have no clinically significant risk to be safe for use in the U. and that the risk to patients is not increased," it said in a statement. "We will continue to monitor the safety and efficacy of the drugs we develop for patients and their families."
Pfizer's drug product, Viagra, is sold by a company called Merck & Co. It has been the subject of a number of investigations, including one in the U. involving an alleged marketing company, and that involving the company's sales force.
In 2011, the Food and Drug Administration found that Merck knew of Viagra's potential risks and promoted the drug on TV. Pfizer, which is based in Cleveland, Ohio, said in a statement it had not disclosed any of the allegations against it.
In January 2012, the company said it had determined that it had no risk to consumers, but declined to discuss the allegations.
A spokesman for Merck said in a statement that the company had acted responsibly in its discussions with the FDA.
Pfizer said it had not acted inappropriately in its discussions with the FDA.
Viagra, the generic version of the drug, is approved by the FDA for the treatment of erectile dysfunction in men and is approved for sale in the U. under the brand name Cialis.
Viagra works by increasing blood flow to the penis, helping men to get and maintain an erection. It was first developed and approved in 1962, and was first marketed in the United States in 1972.
Pfizer said it had not disclosed its concerns about the safety and efficacy of the drugs for patients, and that it would continue to market the drug in the U. as well.
Pfizer said its drug product is available in the U. and that it has not received a favorable response from regulatory agencies. Pfizer said it was working with regulators to find out about the potential risks and other information about the drug.
In May 2014, Pfizer acquired the rights to the drug from a rival company, Eli Lilly & Co. It was the first drug to be approved for treatment of erectile dysfunction. Pfizer acquired the rights to Cialis in 2003 and Cialis in 2006.
Lilly acquired the rights to Viagra in April 2009, and Cialis in December 2009. Lilly acquired the rights to Cialis in October 2009 and Cialis in July 2010.
Pfizer said it was reviewing the information and would review the information in the coming months. It did not comment on the allegations. Pfizer said it would not comment on allegations of violations of law.
The company said it will continue to market Viagra in the U. and has been directed by regulators to market the drug in other countries.
